These Terms of Use (“Terms”) govern access to and use of the website lucerna.luminosfilm.com (the “Site”), operated by Luminos Film S.r.l. (“we”, “us”). By using the Site you accept these Terms. If you do not agree, simply do not use the Site — no hard feelings.
1. What the Site is
The Site presents Lucerna, a macOS application for screenwriting and film production. The Site is informational: it does not process payments and does not host user accounts.
2. Purchases and trial
Lucerna is distributed for macOS through the Mac App Store: you download the app, you get a seven-day trial of the full app with no card and no sign-up, and you unlock it with a single purchase processed by Apple under Apple’s Media Services Terms and privacy policy.
The prices and tiers shown on the Site are our current prices, not decoration. The amount that binds you is the one Apple shows you at checkout, which may differ for local tax, currency, or a change we have published on the Site but Apple has not yet propagated. If the two ever disagree, checkout is what you pay and we correct the Site. The licence terms for the application itself are published here as the End User Licence Agreement, readable before you buy, and are also provided with the app.
3. Intellectual property
The Site’s content — text, design, graphics, the Lucerna name and lantern mark — is owned by us or our licensors and is protected by copyright and trademark law. You may browse, link to, and quote the Site for personal, informational, or review purposes. You may not scrape it wholesale, republish it as your own, or use our marks to suggest endorsement.
Third-party rights. The Site’s comparisons refer to categories of products, not to specific brands, and reflect our good-faith assessment of publicly available characteristics of such categories at the time of writing. Any third-party name, format, or trademark that may nonetheless appear (for example file-format identifiers) belongs to its respective owner, is referenced solely for identification and interoperability, and implies no affiliation or endorsement.
4. Acceptable use
You agree not to: (a) attempt to disrupt or overload the Site; (b) probe or breach its security; (c) use automated means to harvest content beyond ordinary search-engine indexing; (d) frame or mirror the Site for commercial purposes without written consent.
5. No warranty
The Site is provided “as is”. We work hard to keep information accurate and current, but we make no warranty that the Site is error-free, uninterrupted, or that its content — including feature descriptions and comparisons — is free of inaccuracies. Product features evolve, and a screenshot may be a build ahead of, or behind, the version currently on the App Store. Where the Site describes something that is not shipping yet, we say so on the page rather than in here.
6. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from use of the Site. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for wilful misconduct or gross negligence, or your statutory rights as a consumer.
7. Links
The Site may link to third-party sites (for example, Apple’s store pages). We are not responsible for their content or their — usually far longer — terms.
8. Changes
We may amend these Terms from time to time. The current version is always published on this page, with the date of last revision at the top. Continued use of the Site after changes constitutes acceptance.
9. Governing law and jurisdiction
These Terms are governed by Italian law. For any dispute, the competent court is that of Turin, Italy, without prejudice to mandatory consumer-protection rules that designate the consumer’s court of residence.
